Why This Matters
Your Rights as a Texas Real Estate Consumer

Texas law is clear about what you deserve to know before working with any licensed real estate professional.

Before any real estate professional works with you in Texas, they are required by law to give you this disclosure. It explains how a broker can represent you, what duties they owe you, and how fees work.

Understanding these distinctions protects you and helps you make confident decisions throughout your transaction, whether you are buying, selling, or leasing.

Required by Texas Law

The Texas Real Estate Commission (TREC) regulates all licensed real estate professionals in Texas. This disclosure is mandated under the Texas Occupations Code and must be delivered at first contact with any prospective client.

Agent fees are not set by law and are fully negotiable regardless of the type of representation you choose.

Understanding Representation
How a Broker Can Represent You

There are three ways a licensed broker may act in your transaction. Each comes with different obligations.

Agent for Seller or Landlord

Through a listing agreement, the broker represents the property owner. They must put the owner's interests above all others and disclose all material facts about the property or transaction.

Owner Representation

Agent for Buyer or Tenant

Through a written representation agreement, the broker represents you as the buyer or tenant. They must act in your best interest and keep you fully informed throughout the process.

Buyer Representation

Intermediary — Both Parties

With written consent from both parties, a broker can act as a neutral intermediary. They must treat both sides impartially and cannot disclose confidential information to either party.
